These Terms of Service govern your access to and use of the Tactile Oak Co. website and your purchase of products from Tactile Gifts of Morgan County, doing business as Tactile Oak Co. By visiting this website or placing an order, you agree to these Terms of Service.

ELIGIBILITY AND ACCEPTANCE
By using this website or placing an order, you represent that you are legally able to enter into a binding agreement. If you do not agree with these terms, do not use this website or place an order.
PRODUCTS AND CUSTOM ORDERS
Tactile Oak Co. offers custom and made-to-order products, which may include printed apparel, tumblers, coasters, engraved items, embossed items, portraits, wood products, glass products, and other personalized goods.
Product images, mockups, colors, materials, dimensions, and placement are provided as close representations of the finished item as reasonably possible. Minor variations may occur due to screen settings, material characteristics, handmade production, printing methods, engraving processes, and normal production tolerances.
CUSTOMER-PROVIDED CONTENT
If you submit names, text, photographs, logos, artwork, designs, or other content for a custom order, you confirm that:
• You own the content or have the necessary rights and permissions to use it.
• Your submitted content does not infringe another person’s intellectual-property, privacy, publicity, or other legal rights.
• Your submitted content is not unlawful, threatening, hateful, defamatory, obscene, or otherwise inappropriate.
• You grant Tactile Oak Co. permission to use the submitted content solely to create, preview, produce, and fulfill your order.
Tactile Oak Co. may decline, cancel, or request changes to an order if submitted content appears to violate these Terms of Service or applicable law.
ORDER ACCEPTANCE AND CANCELLATION
Submitting an order does not guarantee acceptance. An order is accepted only when Tactile Oak Co. confirms it and begins processing or production.
Tactile Oak Co. may cancel or refuse an order for reasons including product availability, suspected fraud, pricing or listing errors, inability to fulfill a customization request, or content that violates these terms. If payment has already been collected for a canceled order, a refund will be issued for the amount paid for the unfulfilled portion of the order.
Because custom orders may enter production quickly, cancellation or modification requests must be sent immediately to aj@customdesignshop.com. Once production has begun, changes or cancellations may not be possible.
PRICING AND PAYMENT
All prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, product descriptions, and availability may change without notice.
Tactile Oak Co. makes reasonable efforts to ensure pricing and product information are accurate. If a material error occurs, including an incorrect price or description, Tactile Oak Co. may correct the error, cancel the affected order, and issue a refund where applicable.
SHIPPING AND DELIVERY
Tactile Oak Co. currently sells and ships within the United States only. Shipping methods, carriers, costs, and delivery estimates may vary based on the order, destination, package size, and item type.
Any quoted delivery date is an estimate, not a guarantee. Tactile Oak Co. is not responsible for delays caused by carriers, weather, supply disruptions, incorrect customer-provided addresses, or circumstances outside its reasonable control.
Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges may apply if an order must be reshipped because of an incorrect or incomplete address.
RETURNS, REFUNDS, AND REPLACEMENTS
Custom or personalized products are generally not eligible for return, exchange, or refund unless the item arrives damaged, defective, materially different from the approved or submitted customization, or an error was made by Tactile Oak Co.
If there is an issue with your order, contact aj@customdesignshop.com within 7 days of delivery. Include your order number, a description of the issue, and clear photographs when applicable. Tactile Oak Co. will review the request and may offer a replacement, repair, store credit, or refund when appropriate.
Any separate Return and Refund Policy posted on this website is incorporated into these Terms of Service.
INTELLECTUAL PROPERTY
All content on this website, including the Tactile Oak Co. name, branding, logos, photographs, product designs, written content, graphics, and website materials, is protected by applicable intellectual-property laws. No content may be used without prior written permission from Tactile Gifts of Morgan County, except as permitted by law.
THIRD-PARTY SERVICES
This store may use third-party providers, including Shopify, payment processors, shipping carriers, analytics providers, and social-media platforms. Those providers may have their own terms and privacy practices. Tactile Oak Co. is not responsible for third-party websites, services, or content.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, this website and its content are provided on an “as is” and “as available” basis. Tactile Oak Co. does not guarantee that the website will always be uninterrupted, secure, error-free, or free of harmful components.
Nothing in these Terms of Service limits any consumer rights that cannot legally be waived.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Tactile Gifts of Morgan County and Tactile Oak Co. are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this website or purchase of products.
To the fullest extent permitted by law, total liability for a claim related to an order will not exceed the amount paid for the product or service giving rise to that claim.

You agree to indemnify and hold harmless Tactile Gifts of Morgan County, Tactile Oak Co., and their owners, employees, and representatives from claims, losses, damages, liabilities, and expenses arising from your violation of these Terms of Service or your submitted content.

These Terms of Service are governed by the laws of the State of West Virginia, without regard to conflict-of-law rules. Any dispute arising from these terms or your use of this website will be handled in the appropriate state or federal court located in West Virginia, unless applicable law requires otherwise.
